Divorce

Divorce is the process where by parties to a marriage, or either party separately, make a decision that the marriage has come to an end.

​In order to obtain a divorce order from the court, parties have to be separated for a period of 12 months. Furthermore, if as of the date of filing for divorce you have been married for less than 2 years, there is a mandatory requirement for both parties to attend family counseling prior to the filing of divorce.​

Property Division

Khalil Family Lawyers can assist you in the following;​

  • The initial stages following separation which involve providing initial advice in relation to family law property settlements, negotiating with the other party in an attempt to obtain an early resolution of the matter, participating in the exercise of providing full and frank financial disclosure and if agreement reached, entering into Consent Orders of a Financial Agreements formalising the Agreement
  • If required, all representation in the Federal Circuit Court of Australia, or the Family Court Australia, for Court based applications for a division of property interests under section 79 of the Family Law Act 1975(Cth);
  • Advice in relation to the requirement of any urgent property orders including, but not limited to:
    • Orders requiring the freezing of bank accounts;​
    • Orders for the sale of property;
    • Orders preventing the dealing of property;
    • Orders for urgent spousal maintenance

Parenting

  • Khalil Family Lawyers can assist you in the following;​
  • Advice in relation to all parenting matters including family Violence and abuse;
  • Preparing and drafting Parenting Plans;
  • Entering into negotiations with the other side in an attempt to resolve the dispute in accordance to the best interests of the children as under the Family Law Act 1975 (Cth);
  • If required, all representation in the Federal Circuit Court of Australia, or the Family Court Australia, for Court based applications seeking parenting orders;
  • Advice in relation to the requirment of any urgent parenting orders including, but not limited to:
  • Orders requiring the placement of the children on the Airport Watch list;​
  • Orders seeking the recovery of children;
  • Orders requiring the location of children with the involvement of the Australian Federal Police;
  • Orders for relocation of the children;​​

Child Support

  • Providing advice in relation to Limited Child Support Agreements and Binding Child Support Agreements;
  • Advice and assistance in relation to all child support applications to the Australian Government Department of Human Services;
